THE proposal to bar individuals accused of heinous crimes from running in elections raises critical questions about the balance between protecting democratic processes and ensuring fairness for candidates who are merely accused, not convicted.
The issue, highlighted by the recent discussions involving 1-Rider party-list Rep. Ramon Rodrigo Gutierrez and Manila 6th District Rep. Bienvenido Abante, underscores the need for careful legislative scrutiny.
Rep. Abante’s suggestion to disqualify individuals facing heinous crime charges from running in elections appears to stem from a desire to uphold the moral integrity of the candidates. His stance, prompted by concerns over figures like Apollo Quiboloy and Rose Nono Lin, reflects the unease felt by many when individuals facing serious criminal accusations can still seek public office.
Quiboloy’s Senate bid and Lin’s congressional candidacy have ignited debates, particularly since both figures are embroiled in high-profile investigations and accusations of serious wrongdoing.
While the desire to protect the electoral process from being tainted by those involved in criminal activities is understandable, Rep. Gutierrez rightly points out the potential risks of such a proposal.
He cautions that disqualifying candidates at the mere filing of charges, without establishing probable cause, could open the door to abuse. Political rivals may file frivolous or malicious cases as a strategy to eliminate competition, undermining the democratic process.
The safeguard that Gutierrez suggests—disqualifying only after a finding of probable cause—strikes a more reasonable balance between protecting the integrity of elections and ensuring the rights of candidates to be presumed innocent until proven guilty.
The proposal also raises constitutional questions about due process and fairness. Under the current legal framework, as noted by Gutierrez, the Omnibus Election Code allows disqualification based on moral turpitude—a standard grounded in convictions, not accusations.
This is an important distinction. Allowing accusations alone to disqualify candidates could erode the principle of “innocent until proven guilty” and risk transforming elections into battlegrounds of accusation rather than platforms for substantive debate.
Moreover, lawmakers must consider the practical implications of such a law. Heinous crimes, as defined in the Revised Penal Code, carry serious weight, but accusations do not equate to guilt.
While there may be compelling reasons to question the candidacies of individuals like Quiboloy or Lin, particularly given the gravity of the charges they face, the legal system must remain consistent and fair in its treatment of all accused persons.
If the law were to disqualify candidates based on accusations alone, the potential for misuse could far outweigh the intended benefits.
Ultimately, Abante’s proposal merits further exploration, but it must be crafted carefully to avoid potential misuse and ensure that it upholds the fundamental principles of justice.
Legislators need to strike a balance between ensuring that individuals with credible accusations of serious crimes do not abuse the electoral process while protecting the rights of legitimate candidates from politically motivated charges.
As the House of Representatives debates this issue, lawmakers must ensure that any changes to election laws are clear, just, and in line with the principles of fairness and due process.
The stakes are high—both for the integrity of the electoral system and for the individuals seeking to serve the public. In a democracy, elections should be about offering voters the best candidates for the job, not about disqualifying individuals based on unproven accusations.
